Flit Terms of Service

1. Accounts and Access

• You need an account to use most features (currently via waitlist email; full accounts will use OAuth with JWT and upcoming SSO).
• You're responsible for keeping your login details secure and for all activity on your account.
• The Service is offered as-is during its early stages. Access may be limited, features may change, and we may pause or restrict accounts if needed to protect the system.

2. Free and Paid Features

• All Flit apps (mobile and web) are 100% free forever.
• Core features—cloud database sync and optional off-device AI speech-to-text—are available through a paid subscription (details will be shown in-app when launched).
• Payments will be processed via Dodo Payments. We do not store your full payment card details; they are handled securely by the provider.
• Subscriptions auto-renew unless cancelled. No refunds for partial periods except where required by law.

3. Your Content and Privacy

• You own all your notes, voice recordings, journal entries, and any other content you create ("Your Content").
• In the Flit apps, transcription and AI processing happen 100% on-device—nothing leaves your phone unless you explicitly opt into Core off-device processing.
• If you subscribe to Core and enable off-device speech-to-text, you grant us a limited, revocable license to process that audio solely to provide the transcription service. We delete the audio immediately after processing.
• We will never sell, share for advertising, or use your personal content for training public AI models.

4. Acceptable Use

While we don't impose unusual restrictions, you agree to use Flit only for lawful, personal purposes and not to:

• interfere with the Service or other users,
• upload harmful code,
• attempt to access data that isn't yours, or
• use the Service in ways that violate third-party rights.

Basically: be kind to the system and to others.

5. Intellectual Property

• Flit (code, design, branding) belongs to us. You get a limited, non-transferable license to use the Service for personal knowledge management.
• You keep full rights to Your Content and any insights you generate.

6. Disclaimers and Limitation of Liability

• Flit is provided "as is" without warranties. We're in active development—things might break, change, or be temporarily unavailable.
• AI transcriptions and insights are helpful tools, not perfect or professional advice (especially for wellness features). Always verify important information yourself.
• To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Total liability is capped at the amount you paid us in the last 12 months (or ZAR 1,000 if you paid nothing).

7. Termination

• You can stop using Flit and delete your account anytime.
• We may suspend or terminate access if you breach these Terms or if we discontinue the Service.

8. Changes to Terms

We may update these Terms from time to time. We'll notify you (via email or in-app) of material changes. Continued use after changes means you accept the new Terms.

9. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the competent courts of South Africa.

1. Data We Collect

• Account data: Email address (for waitlist and login), and any profile details you add.
• Usage data: Anonymous analytics about which features you use (to improve the apps—no personal identifiers).
• Content: Your notes, voice recordings, journals—processed primarily on-device.
• Payment data: If you subscribe, billing info is handled securely by our payment processor (we only receive confirmation and subscription status).
• Off-device audio: Only if you explicitly enable Core off-device speech-to-text; deleted immediately after transcription.

2. How We Use Your Data

• To provide and improve the Service (account management, sync, optional transcription).
• To communicate updates, feature announcements, or support responses.
• To process payments and manage subscriptions.
• For legal compliance if required.

We do not:

• Sell your data.
• Share it for marketing.
• Use your personal content to train AI models.
• Track you across other sites or apps.

3. Data Storage and Security

• Your encrypted content (when using Core sync) is stored on secure servers in the United States (via Render, US East region).
• We use industry-standard encryption in transit and at rest.
• On-device processing means most sensitive data never leaves your phone.

4. International Data Transfers

Data may be transferred to and processed in the United States. We implement appropriate safeguards to protect your information in accordance with South African law (POPIA).

5. Your Rights

Under POPIA and applicable laws, you may:

• Access, correct, or delete your personal data.
• Object to or restrict certain processing.
• Withdraw consent where we rely on it.
• Lodge a complaint with the Information Regulator (South Africa).

6. Data Retention

• Account data: Kept while your account is active; deleted on request or after prolonged inactivity.
• Content: Deleted when you delete it or your account.
• Transaction records: Kept as required for tax/legal purposes.

7. Children's Privacy

Flit is not directed at children under 13. We do not knowingly collect personal data from children. If we learn we have, we'll delete it promptly.

8. Changes to This Policy

We may update this Policy occasionally. Significant changes will be notified via email or in-app notice.
